AFTER SCHOOL LICENSING

SB 1604 by Senator Torres

This bill expands the definition of "after school program" to include holiday programs, inservice training days, and school breaks. Also includes programs providing transportation; meals or snacks; educational, artistic, athletic, or self-directed activities; tutoring or homework assistance; takes children on field trips; or holds itself out as being an after school program.

CHILD CARE TRANSPORTATION

SB 94 by Senators Stewart and Torres

HB 69 by Representative Antone

Child Care Facilities; Citing this act as the "Child Safety Alarm Act"; requiring that, by a specified date, vehicles used by child care facilities and large family child care homes to transport children be equipped with a reliable alarm system that prompts the driver to inspect the vehicle for children before exiting the vehicle; requiring the Department of Children and Families to adopt by rule minimum safety standards and to maintain a list of approved alarm manufacturers and alarm systems, etc.

For those agencies with licensed before/after school programs, this bill requires alarms to exist in vehicles used to transport children.

GOVERNMENT SPONSORED RECREATION PROGRAMS (Child Care)

Revises the definition of "child care facility" to exclude government sponsored recreation programs.

  • The bill is scheduled to be heard 4/8 in its first Senate Committee.  After discussions with staff of the City of Orlando, we were able to agree to propose an amendment to the language in the bill that would allow a parks and recreation agency to "opt-in" to the licensing program should this bill pass.  In essence, you would be opting out of being exempt and would be able to maintain your license through DCF should you desire to do that. 

    Here is the material on SB 1492 that has been included in the legislative committee meeting packet for today's meeting.  A couple of things you should pay careful attention to -

    • Beginning on line 49 there is language that was inserted (we are not sure of the source of this) that if you were exempt, would EXCLUDE your agency from receiving funding through the Child Care Development Block Grant program and does not allow you to provide school readiness programming.  Read this section clearly and evaluate whether this affects your program.
    • Beginning on line 71 the language specifies that should you waive the exemption granted if this bill passes (therefore you wish to maintain your license or pursue licensing) you can not then go back and select to be exempt as a government sponsored recreation program.  Again, we do not know the source of that, but would anticipate that could be seen as a way to keep programs from bouncing in and out of licensing.

YOUTH ATHLETIC ACTIVITY

SB 1696 by Senator Broxson
Defining the terms “athletics personnel” and “high-risk youth athletic activity”; requiring an entity that administers or conducts a high-risk youth athletic activity or training related to such activity on certain property to require certain unpaid or volunteer personnel to complete a specified course; requiring such personnel to complete the course within a specified number of days and then annually thereafter, etc. The term includes, but is not limited to, the sports of football, basketball, baseball, volleyball, soccer, ice or field hockey, cheerleading, and lacrosse.
